			<content:encoded><![CDATA[<p>Federal Reserve and Treasury officials said on Wednesday they were struggling to craft rules to ban bank and credit card payments to illegal Internet gambling sites because federal law is unclear about what type of gambling is illegal online.</p>
<p>  &#8220;That is something we&#39;re really struggling with,&#8221; Louise Roseman, the Fed&#39;s director of reserve bank operations and payment systems, told a House Financial Services subcommittee.</p>
<p>  &#8220;The challenge we have is interpreting &#8230; federal laws that Congress itself isn&#39;t sure what they mean,&#8221; Roseman said.</p>
<p><span id="more-95"></span>
<p>  Congress passed a bill in 2006, when Republicans were still in control of the Senate and the House of Representatives, that prohibits companies from accepting payments in connection with &#8220;unlawful Internet gambling.&#8221; It also instructed the Federal Reserve and the Treasury Department, in consultation with the Justice Department, to come up with rules to enforce the act.</p>
<p>  But, rather than define what types of gambling are illegal online, the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA) relied on existing Federal and state laws to answer that question. It also still allowed any online horserace betting permissible under the Interstate Horseracing Act of 1978.Now, both gambling and financial industry companies want to be told specifically which transactions should be blocked.</p>
<p>  &#8220;Clarity on this point would permit them to design policies and procedures that they could be assured would meet the rule&#39;s requirements,&#8221; Roseman said. &#8220;Still others, including some gambling businesses and many consumers, asked that the rule clarify that certain types of gambling, such as pari-mutuel betting or poker, are lawful.&#8221;</p>
<p>  The payment system that companies rely on to do business &#8220;isn&#39;t frankly well designed&#8221; to identify an illegal Internet gambling transaction from a legal one, which is another challenge to crafting a rule, Roseman said.</p>
<p>  Valerie Abend, deputy assistant secretary of Treasury, said regulators were striving to craft a rule that comes as close as possible to what lawmakers intended. But the question of which forms of Internet gambling are illegal is an issue regulators &#8220;are struggling with and trying to figure out what, if anything, we can do,&#8221; Abend said. The 2006 law has incurred the wrath of the European Union, which argues that it discriminates against European gambling operators. U.S. Rep. Barney Frank, the Massachusetts Democrat who chairs the House Financial Services Committee, has proposed legislation to repeal the ban.</p>

<p> Antigua accuses the U.S. of crippling its gambling industry by banning Americans from placing online bets with gambling operators, including those based in the twin-island nation of 70,000 people. Last month, the World Trade Organization backed Antigua&#39;s request to target U.S. services, copyrights and trademarks in retaliation for a U.S. online betting ban, but ruled it could impose only $21 million in annual trade sanctions.</p>
<p><span id="more-33"></span>
<p>  Finance Minister Errol Cort, speaking to reporters before boarding a flight to Washington, said a Thursday sit-down with U.S. Trade Representative Susan Schwab would be the first &#8220;detailed discussions&#8221; between the tiny Caribbean islands and the United States over the gambling discord.</p>
<p>  &#8220;We believe this matter can be settled in an amicable way because we enjoy an excellent relationship with the United States,&#8221; Cort said. &#8220;I am therefore hopeful (we can) come to some broad understanding in terms of settlement.&#8221; Cort has described the WTO&#39;s decision as a setback for Antigua, which had sought to apply $3.4 billion in retaliatory measures against U.S.</p>
<p>  A law passed by the U.S. Congress in 2006 bars banks and credit card companies from processing payments to online gambling businesses outside the country. The regulation effectively blocks Antigua&#39;s access to the U.S. gambling market, the most lucrative in the world.</p>

			<content:encoded><![CDATA[<p>U.S. authorities arrested eight people on Monday in connection with a Costa Rica-based online sports gambling operation they said made millions of dollars in profits annually. Twelve men face charges including conspiracy and illegal gambling in an indictment unsealed on Monday in Manhattan federal court for their role in operating a gambling Web site and call center that serviced U.S.-based sports bookies.</p>
<p>  U.S. prosecution of foreign <a href="http://casinochrome.eu">online gambling</a> companies has drawn criticism from such companies in Europe, who have accused the Justice Department of violating World Trade Organization rules by singling out foreign companies in such cases. In the latest case, U.S. prosecutors said that starting in 2005 Carmen Cicalese headed the operation out of Costa Rica, charging several hundred U.S. bookies weekly fees of $15 to $30 for each gambler they registered.</p>
<p><span id="more-28"></span>
<p>  The gamblers then placed sports bets either via a toll-free number or on Web sites including datawager.com and betwestsports.com, the indictment said. While the operation set the odds for the bets, the payouts were left to the bookies, authorities said.</p>
<p>  U.S.-based &#8220;runners&#8221; for the operation collected the fees and transferred the money back to Costa Rica through couriers, credit cards and electronic funds bank transfers. Eight arrests were made in the states of New York, Massachusetts and Maryland. Cicalese remains at large, authorities said.</p>
<p>  In December the European Union agreed to let Washington withdraw a 13-year-old commitment to allow foreign firms to offer gambling services in exchange for U.S. trade concessions in other areas. The deal followed U.S. legislation in 2006 that made it illegal for credit card companies to accept charges for online gambling, effectively closing the market to foreign companies. </p>
